         <title>Warrant Slapped on Warrant Singer for Skipping Out on Los Angeles DUI Hearings</title>
         <description><![CDATA[<p>As this blog reported, last June 17th, Jani Lane of the 80’s rock band Warrant was arrested for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">driving under the influence in Los Angeles</a>. The “Cherry Pie” singer is back on the headlines once again after failing to show up for two hearings pertaining to his Los Angeles DUI probation.<img alt="Jani%20Lane%20DUI%202.jpg" src="http://www.losangelesduiattorneyblog.com/Jani%20Lane%20DUI%202.jpg" width="194" height="226" /align=left></p>

<p><br />
The 46-year old singer pled no contest to his misdemeanor L.A. DUI charge and got a relatively light sentence that included three months of alcohol school, one month of community service, and three months of probation. He was due in court on February 23rd, 2010, but he didn’t show up. The judge rescheduled his appearance for February 24th, but Lane again failed to show. According to the website TMZ.com, Lane’s lawyer said that the singer is in the hospital for unknown reasons, and that he will not show up in court until next week. </p>

<p>The judge in Lane’s case has actually issued a warrant for the lead singer of the band Warrant – an irony not lost on Lane’s fans and snarky commentators in the media and blogosphere.</p>

<p>Lane’s <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1530883.html"target=_blank">DUI in Burbank</a> accident occurred at the corner of Topanga and Ventura Boulevards. At the time, he got out of jail by posing a $30,000 bail. The minor traffic accident did not result in any serious injuries to any parties, fortunately.</p>

<p>But what if it had? </p>

<p>Two key sections of California Vehicle Code stipulate punishments for individuals who injure others while <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1520307.html"target=_blank">driving under the influence in Burbank </a>or elsewhere in California. These sections are <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1359803.html"target=_blank">23153(a) and 23153(b)</a>. </p>

<p>23153(a) </p>

<p>This section says that if you drive DUI and cause an accident that leads to someone being injured, this will elevate an ordinary misdemeanor DUI charge to a felony DUI charge, assuming that the injury was directly or indirectly caused by the DUI driver’s use of drugs and/or alcohol. </p>

<p>23153(b) </p>

<p>This section says something quite similar. It says that if you operate a motor vehicle with a blood alcohol concentration (BAC) exceeding the state’s legal limit of 0.08%, and then you hit someone and cause an injury or otherwise violate the law and cause an injury, this can be charged as a felony. 23153(b) also lays out the punishments that can be imposed, which range from jail time to forced restitution to a victim (and/or the victim’s family) to steep fines and court costs.</p>

         <title>Southern California DUI NewsFlash -- Anti-gay lawmaker busted for driving under the influence after speeding away from a gay bar in Sacramento!</title>
         <description><![CDATA[<p>A <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">Southern California DUI</a> arrest has the national media buzzing with its political implications. Early last Wednesday morning in Sacramento, State Senator Roy Ashburn from Bakersfield (R), was pulled over by the California Highway Patrol for driving erratically.  Unidentified sources reported that the Senator had been partying at a local gay hotspot called Faces, and he had a male companion with him in his car. Ashburn has been a vociferous opponent of gay rights in California. For instance, he pushed hard for California’s Proposition 8, which passed in 2008, banning gay marriages in the state.<img alt="roy-ashburn-dui.jpg" src="http://www.losangelesduiattorneyblog.com/roy-ashburn-dui.jpg" width="178" height="198" /align=left></p>

It is uncertain whether the 55-year-old Senator’s male companion (who was with him at the time of the arrest) was in any way linked with the Senator romantically.</p>

<p>Following his DUI arrest, Ashburn issued the following statement: “I am deeply sorry for my actions and offer no excuse for my poor judgment. I accept complete responsibility for my conduct and I am prepared to accept the consequences for what I did.”</p>

<p>Ashburn faces a primary challenge from another Republican for re-election to State Senate. According to various news reports, Ashburn has been charged with driving under the influence in Southern California as well as driving with a BAC above the state’s legal limit of 0.08%.</p>

<p>The News in Depth</p>

         <title>“Guilty” Verdict Handed Down in Southern California DUI Case for Pro Bowl Wide Receiver</title>
         <description><![CDATA[<p>Last Wednesday, Chargers wide receiver Vincent Jackson pled guilty to <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">driving under the influence in Southern California</a> in January 2009, and prosecutors set the terms of his sentencing.<img alt="vincent-jackson-dui.jpg" src="http://www.losangelesduiattorneyblog.com/vincent-jackson-dui.jpg" width="219" height="177" /align=left></p>

<p><br />
The 27-year old Jackson had been arrested in January with a BAC of 0.17% (California’s legal limit is 0.08%). The January ’09 arrest was actually his second Southern California DUI. He was busted in June 2006 and convicted for that DUI -- netting him a $1,750 fine and five years of probation. This time, he did not get off so easily. In addition to a concomitant fine (of $2,408) and another five years probation, the wide receiver will have to do 15 days of community service and will likely be suspended by the National Football League for at least two games.</p>

<p>In light of recent comments Jackson made in the radio interview, during which he taunted his prosecutors, many analysts are saying that Jackson is getting off pretty easy. For a comparison, the City Attorney’s Office had requested the Judge to give Jackson 180 days in jail -- also known as “substantial custody.” City attorneys were also miffed because Jackson managed to pull off a string of continuances that allowed him to delay his Southern California DUI sentencing until after the NFL season. (Nevertheless, San Diego’s City Attorney did not oppose the two continuances when they were filed.)</p>

<p>The Jackson sentence may or may not be an aberration, depending on who you speak to. But how do the sentencing guidelines differ for first and second time <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1530883.html"target=_blank">Burbank DUI</a> offenses?</p>

<p>Sentencing can depend on a host of factors, including the context of the DUI arrest, whether or not the defendant cooperates with prosecutors, whether anyone was injured during, and so forth.</p>

•	Fines and court costs which can be much higher than first time DUI fines<br />
•	Probation terms which can be much stricter than terms for first time violators</p>

         <title>Southern California DUI Blogosphere Lights Up As Son of Recently Deceased “Deadliest Catch” Captain Gets Arrested For DUI in Seattle</title>
         <description><![CDATA[<p>Online blogs and websites that cover celebrity <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">Los Angeles DUI</a> news have been fiercely debating the arrest of Jake Harris, the 24-year-old son of the late Captain Phil Harris, a fish boat captain who appeared on multiple seasons of Discovery Channel’s “Deadliest Catch.”<img alt="jake-harris.jpg" src="http://www.losangelesduiattorneyblog.com/jake-harris.jpg" width="183" height="200" /align=left></p>

<p><br />
According to Washington State Troopers, Harris had been driving on a suspended license and had gotten involved in a hit and run accident prior to his arrest. After a motorist reported an out-of-control driver on interstate 5, the police ID’d Harris’ vehicle and, using aerial assistance, pulled him over. Harris was arrested at the scene and charged with hit and run as well as a DUI.</p>

<p>Fortunately, no one was reportedly injured in the earlier hit and run accident, and Harris himself seems to have escaped uninjured as well, although he remains behind bars as of the publishing of this blog post. Harris’ situation does raise some interesting issues, however.</p>

         <title>NHL All Star Goalie Slapped with DUI Charge: Not a Beverly Hills DUI, But Arrest Has Nevertheless Attracted Tons of Media Attention</title>
         <description><![CDATA[<p>Many <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1530825.html"target=_blank">DUI in Beverly Hills</a> cases begin when an intoxicated celebrity drives way over the speed limit in a fancy car and gets nabbed by the police for his or her hubris. Well, All Star NHL Goalie Nikolai Khabibulin was arrested last week for doing just that, when he was cuffed near Scottsdale, Arizona. Here is the story:<img alt="goalie_dui.jpg" src="http://www.losangelesduiattorneyblog.com/goalie_dui.jpg" width="258" height="193" /align=left></p>

<p><br />
On February 8th, the goaltender blasted his red Ferrari down a Scottsdale road at 70 miles per hour -- more than 25 miles per hour over the speed limit. Local police pulled over the 37-year-old and gave him a field sobriety test after noticing the odor of alcohol on him. Khabibulin was subsequently arrested and charged with DUI and speeding. According to the General Manager of the Oilers, “Nikolai has been fully cooperative with the authorities.” </p>

<p>Khabibulin, who signed a $15 million contract with the Edmonton Oilers in 2009, has been out since mid November thanks to a lower back injury. The Oilers have struggled without his finesse -- racking up the worst record in the league (19-36-6). (For comparison, Khabibulin’s record was 7-2-9 with just over three goals scored against on average for the '09-'10 hockey season.)</p>

<p>When police officers make DUI stops -- whether they do so in Scottsdale or Southern California -- what kinds of tests do they conduct?</p>

<p><a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1530825.html"target=_blank">Beverly Hills DUI police</a> typically handle roadside stops ritualistically. In other words, they adhere tightly to a pre-scripted procedure: </p>

<p>The first kind of <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357108.html"target=_blank">Southern California DUI field sobriety test</a> usually given is the <b>horizontal gaze nystagmus test</b>. This is an eye exam designed to see whether the driver can track an object across a field of view. If the eye bounces around, this might indicate that the suspect is DUI. </p>

<p>The following test is the <b>walk the line test</b>. This is a balance test. A suspect must step nine paces in two directions over a line (such as a yellow dividing line). If she falls over, that might indicate she has been driving under the influence in Beverly Hills.</p>

<p>The next test is the <b>one-leg stand test</b>. This is another balance test. The driver stands on one foot for half a minute. Again, if he or she loses balance, this might indicate DUI.</p>

<p>The next test is the <b>Rhomberg test</b>, in which a driver tilts his head back and counts from 1 to 30. Again, a loss of balance might indicate DUI. <br />
Officers can also employ <b>coordination tests</b>, such as the finger to the nose test. </p>

<p>Finally, <b>mental coordination tests</b> may be employed as well -- such as reverse counting tests.</p>

<p>Just because you fail a <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">Beverly Hills DUI</a> field sobriety test doesn't necessarily mean that you will be convicted. But you may need solid legal representation to help you build a good defense.<br />

         <title>Serial Traffic Offender Kills Girl in DUI Crash: Parallels Other Cases of Southern California DUI Homicide</title>
         <description><![CDATA[<p><a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1520309.html"target=_blank">Driving under the influence in Long Beach</a> (or anywhere else in Southern California) is a serious criminal act -- one that can lead to horrific tragedies. Sadly, a 48-year-old man, Eddie Lumpkin, stands implicated in a recent and frighteningly brutal DUI homicide -- this case out of Chicago.<img alt="Eddie_lumpkin_dui.jpg" src="http://www.losangelesduiattorneyblog.com/Eddie_lumpkin_dui.jpg" width="150" height="212" /align=left></p>

<p><br />
On Tuesday, Lumpkin -- who had been decorated with over three dozen traffic offenses over the past 20 years, according to the Chicago Sun-Times – plowed his van into six-year-old Jada Washington, killing her. Washington’s aunt, Tiuette Richardson, was severely hurt as well.</p>

<p>Despite all his traffic offenses (his latest occurred just weeks ago on January 31st, when he blew through a stop sign), amazingly, Lumpkin still had an Illinois drivers’ license.  According to the Chicago Tribune, “The court records provide little information about why the tickets were dropped, but it could have been a lack of evidence, the failure of police officers to show up in court or any number of other things.”</p>

<p>Lumpkin has been charged with two counts of aggravated DUI as well as reckless homicide.</p>

<p>The laws concerning <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1359796.html"target=_blank">DUI murder in Southern California</a> differ somewhat from the applicable Illinois laws. If Lumpkin had a hit and killed a six-year-old while driving under the influence in Long Beach, for instance, he could be charged with Gross Vehicular Manslaughter while Intoxicated (<a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1359806.html"target=_blank">CA Penal Code Section 191.5(a)). <br />
</a><br />
To win a case like this, prosecutors would have to show four things: </p>

<p>1. Lumpkin was under the influence of alcohol or drugs and drove with a BAC of 0.08% or higher. </p>

<p>2. While driving <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1533932.html"target=_blank">DUI in Long Beach</a> (or anywhere else in Southern California), Lumpkin committed a misdemeanor, traffic offense or other act that could lead to death. </p>

<p>3. Lumpkin performed this misdemeanor, infraction or act with what’s known as “gross negligence” -- a standard of carelessness that’s beyond ordinary inattention or bad judgment. </p>

<p>4. The gross negligence led to the death of the six-year-old girl.</p>

<p>Cases of Gross Vehicular Manslaughter while DUI in Southern California can become incredibly complicated and can stretch out over months, if not years.</p>

<p>The consequences of a less than exact defense could lead to extreme punishments.          <title>Double Trouble: Twin felony Los Angeles DUI charges handed out after two DUI drivers crash into each other</title>
         <description><![CDATA[<p>On January 23rd, two individuals both <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1520307.html"target=_blank">driving under the influence of alcohol in Burbank </a>collided into one another, causing minor injuries and damage. According to investigating officer, James Laforce, here is what happened:<img alt="dui-in-manhattan-beach.jpg" src="http://www.losangelesduiattorneyblog.com/dui-in-manhattan-beach.jpg" width="206" height="306" /align=left></p>

<p><br />
A car traveling eastbound on Sherman Way attempted a U-turn, when an oncoming truck plowed into it, knocking the car onto a nearby curb. The truck, meanwhile, slammed into a Ford Mustang parked nearby. The truck driver -- along with his passenger -- fled the scene, but both men were apprehended and arrested shortly thereafter for trying to break into someone’s residence. </p>

<p>The truck driver got tagged for a felony hit and run charge; he is currently being investigated for a misdemeanor DUI charge. Meanwhile, the 20-something-year-old woman who had been driving the car got taken to hospital for minor injuries. Reports suggest that neither her, nor her passengers, suffered any life-threatening injuries. Nevertheless, the woman was hit with a <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1358053.html"target=_blank">felony Los Angeles DUI charge</a>.</p>

<p>Laforce had this to say about the accident: “it was ugly… they are lucky they are alive.”</p>

<p>In this Burbank DUI instance, fortunately no one got seriously injured or killed. But what happens if someone dies in a Southern California DUI crash? What kinds of charges might a driver face?</p>

<p>The answer, obviously, depends on the circumstances of the accident. <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1359806.html"target=_blank">California Penal Code Section 191.5(a) </a>describes the charge of gross vehicular manslaughter while intoxicated. To prove this kind of charge, prosecutors must show four key things: <br />
1) The person drove a motor vehicle with a BAC of 0.08% or higher; or otherwise clearly drove under the influence of a drug; <br />
2) The person committed a driving infraction or unlawful act -- such as a misdemeanor -- that could potentially cause someone to die; <br />
3) The driver not only committed this unlawful act or infraction, but he or she did so with gross negligence; <br />
4) This gross negligence led to someone’s death.</p>

<p>DUI murder charges (a.k.a. Watson murders) carry even stiffer penalties and harsher jail sentences than do charges of gross vehicular manslaughter while intoxicated.</p>

         <title>Hit and Run Southern California DUI Accident Embroils Manhattan Beach Police Department in Scandal</title>
         <description><![CDATA[<p>A <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">Southern California DUI</a> crash has rocked the Manhattan Beach Police Department.<img alt="dui-arrest-in-burbank.jpg" src="http://www.losangelesduiattorneyblog.com/dui-arrest-in-burbank.jpg" width="250" height="180" /align=left><br />

<p>Here is the story, as reported in The Daily Breeze:</p>

<p>#1) On January 31, a car collided with two other vehicles at the intersection of Sepulveda Blvd. and Manhattan Beach Blvd. </p>

<p>#2) The driver fled the scene and abandoned his vehicle at a nearby Arco Gas Station parking lot. </p>

<p>#3) Police called in to investigate discovered that the driver was one of their own -- a fellow Manhattan Beach officer. </p>

<p>#4) Instead of arresting their cohort for Southern California DUI and hit and run, the officers did not issue any report or make any arrests.</p>

<p>#5) News of this dereliction of duty reached the Manhattan Beach Chief of Police, Rod Uyeda, the next day. </p>

<p>#6) Uyeda quickly alerted the LA County Sheriff’s Department to conduct an internal investigation, and he issued a public statement to the community to reassure them that the actions of the few independently-minded police officers should not be construed as indicating that the Manhattan Beach Police Department would condone or tolerate bad behavior.</p>

<p>Fortunately, the two other drivers hit on January 31st suffered only minor injuries (and some property damage to their vehicles). The <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1358053.html"target=_blank">Southern California DUI </a>hit and run cover up comes on the heels of a similar incident last September that took place in Torrence at the corner of Robert Road and Pacific Coast Highway. (A Torrence police sergeant drove under the influence of alcohol, hit another vehicle, and sped away from the scene.)</p>

         <title>Mel Gibson’s 2006 Los Angeles DUI Back in the News after Gibson Curses TV Reporter</title>
         <description><![CDATA[<p>Mel Gibson’s 2006 <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1358053.html"target=_blank">Los Angeles DUI</a> arrest may have been the most written-about celebrity DUI arrests of the past decade. That’s saying a lot, given the wall-to-wall coverage that celebrity DUIs merit (see, for example, the DUIs for Lindsay Lohan, Nick Nolte, Stephanie Pratt, etc.). <img alt="mel_gibson_dui.jpg" src="http://www.losangelesduiattorneyblog.com/mel_gibson_dui.jpg" width="196" height="250" /align=left></p>

<p><br />
Gibson’s arrest on Pacific Coast Highway on July 28, 2006 was relatively “ordinary” as far as <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1473870.html"target=_blank">Beverly Hills DUI </a>arrests go. He was driving more than 40 miles over the speed limit with a BAC that later tested at 0.12% (California’s legal limit is 0.08%), when he was pulled over and arrested by Malibu police deputy James Mee. Gibson allegedly launched into an anti-Semitic rant, behavior that he later admitted was “despicable.”</p>

<p>Gibson and his publicists worked hard to put that memorable Southern California DUI arrest in the past. But old wounds opened on Wednesday February 3rd when the actor lashed out against Chicago television reporter Dean Richards (WGN TV), after Richards brought up the DUI during a TV interview about Gibson’s latest film, Edge of Darkness. Richards asked the actor about his “drinking problems” and “the anti Semitic rant.” Gibson shot back “that was almost four years ago, dude. I’ve moved on. I guess you haven’t.” Then, Gibson called the reporter an a****** -- apparently unaware that the cameras were still rolling. (Gibson and his publicists have since done another round of damage control to keep this latest bit of hostility under wraps.) </p>

<p>Any mention of Gibson’s arrest would be incomplete without a brief discussion of the penalties typically doled out for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357110.html"target=_blank">misdemeanor Southern California DUI</a>. Even if it’s only your first time pulled over for driving under the influence, you can still be subject to any one (and possibly even all) of the following punishments:</p>

<p>•	Six weeks of DUI alcohol school (maximum nine months)<br />
•	Strict terms of probation for release. You may have to check in with a California probation officer periodically and adhere to other conditions and terms to get released. <br />
•	One year suspension of California drivers’ license -- no restricted license allowed<br />
•	A $1,000 fine<br />
•	Court costs (which can be significantly more than $1,000)<br />
•	Mandatory jail time of two full days in custody (48 hours); maximum half a year in jail<br />
•	Mandatory installation of interlock ignition device (IID) in your vehicle. (For instance, had Gibson been arrested for a Southern California DUI today instead of in 2006, he would have been compelled by law to install an IID in his 2006 Lexus LS 430.)</p>

<p>How can you effectively construct a defense so you won’t have to endure these (many) penalties for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1473787.html"target=_blank">driving under the influence in Burbank</a> or elsewhere in Los Angeles? </p>

         <title>Southern California DUI Statistics for Super Bowl Sunday 2010</title>
         <description><![CDATA[<p>Super Bowl Sunday is a dangerous day for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">Southern California DUI </a>incidents. Statistically, only New Year’s Eve sees more Los Angeles DUIs. We’re going to take a look at Southland DUI statistics for Super Bowl Sunday. <img alt="saints-colts-super-bowl-xliv.jpg" src="http://www.losangelesduiattorneyblog.com/saints-colts-super-bowl-xliv.jpg" width="232" height="175" /align=left></p>

<p>•	According to the Orange County Register, in 2009, 11 people died in DUI related accidents - more than 3 times the average for Southern California DUI deaths. Also last year, 160 DUI crashes were reported in CA - twice the daily average.</p>

<p>•	The DUI spike is a known and serious problem. The Automobile Club of Southern California recently analyzed crash data and found that DUI crashes on Super Bowl Sunday leap 27% (220 people hurt/killed in DUI crashes vs. 174 people hurt/killed in DUI crashes on an average day in CA.) </p>

<p>•	In Los Angeles proper, the spike is even spikier. We see a whopping 33% increase in Los Angeles DUI crashes/deaths on average for Super Bowl Sunday (72 people hurt/killed vs. 54 hurt/killed on a normal day).</p>

<p>Fortunately, the majority of Burbank DUI arrests and auto accidents end without injury to any party. Here in California, injury DUIs are covered by <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1359803.html"target=_blank">California Vehicle Code Section 23153(a) and 23153(b</a>). Let’s dive into these two laws to get a better understanding of what they prohibit and how the mete out punishments. </p>

<p>According to 23153(a), a driver who would ordinarily be charged with a misdemeanor <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1530825.html"target=_blank">Beverly Hills DUI</a> can be hit with a felony charge if she injures another person in an accident that can be clearly linked to her alcohol/drug use. </p>

<p>Section 23153(b) says that someone who drives with a BAC of 0.08% or more and who then violates California traffic laws and directly or indirectly hurts another person can be sent to prison. This section also lays out other punishments that can be imposed, such as court fines, jacked up insurance rates, and forced restitution to the victim or the family of the victim. </p>

<p>That being said, just because you're arrested for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1530826.html"target=_blank">driving under the influence in West Hollywood</a> (or elsewhere in Southern California, such as Long Beach or Burbank), and someone got hurt in the accident doesn’t mean that you will be slapped with a felony charge. For the prosecution to succeed with a case against someone for violating 23153(a) or 23153(b), they must show that the driver violated traffic laws, behaved negligently, and caused the accident. </p>

<p>For instance, if you drove DUI (BAC of 0.08% or above), but the other driver caused the accident: you can still get a misdemeanor DUI, but you won’t likely get a felony DUI. Likewise, if you drive DUI and caused an accident, but you did not violate any traffic laws or act in a negligent way then you will be susceptible to a misdemeanor charge but likely not to a felony. </p>

         <title>Los Angeles DUI Charge for &quot;Heroes&quot; Actor Adrian Pasdar</title>
         <description><![CDATA[<p>On Wednesday, January 27, Adrian Pasdar, star of NBC's "Heroes" series, was pulled over for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">driving under the influence in Los Angeles</a>. According to reports, the 44-year-old actor was speeding on the 405 in his Ford F-150 truck at nearly 100 miles per hour -- straddling two lanes of traffic -- when the California Highway Patrol pulled him over at 3 a.m. near Santa Monica Boulevard. After noticing an odor of alcohol coming from his car, the cops gave him a field sobriety test. Pasdar refused a breathalyzer and was remanded to County Jail and held on a $15,000 bond, which he posted at 8:30 AM. His misdemeanor Los Angeles DUI trial has been scheduled for February 24. Pasdar is married to Natalie Maines, one of the lead singers for the Dixie Chicks.<img alt="Adrian_Pasdar_DUI.jpg" src="http://www.losangelesduiattorneyblog.com/Adrian_Pasdar_DUI.jpg" width="178" height="240" / align=left> </p>

<p>Whether you're pulled over for a Long Beach DUI on the 405 South, or a Burbank DUI on the 101, the California Highway Patrol administers similar kinds of field sobriety tests. What are the <b><a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357108.html"target=_blank">typical field sobriety tests (FSTs)</a></b>, and how do they purport to work? Here's a quick primer:</p>

<p><b>Gaze tests</b> </p>

<p>The Horizontal Gaze Nystagmus test determines pupil coordination. An officer tracks the eye movement of a suspect following an object or a light.</p>

<p><b>Balancing tests</b> </p>

<p>Common balancing tests include the One Leg Stand test, the Walk the Line test, and the Rhomberg test. With the One Leg Stand test, a driver is asked to stand on one leg. If he or she tips over, this might indicate DUI. The Walk the Line test is perhaps the most famous Southern California DUI field sobriety test. A suspect must walk nine paces back and forth on a straight line (e.g. a highway divider line). If the suspect "falls off," then he or she might be suspected. Finally, the Rhomberg test involves leaning back and counting to 30. Again, tipping over might indicate intoxication.</p>

<p><b>Coordination tests</b> </p>

<p>The so-called Finger to the Nose test is perhaps the most common. In this exam, a driver closes her eyes and attempts to touch her nose after extending her arms. If the driver cannot "find" her nose, then DUI may be suspected.</p>

<p>Officers will also look for indicators of demeanor and constitution. For instance, let's say police pull over a person on suspicion of<a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1533932.html"target=_blank"> driving under the influence in Long Beach</a> on the 405 South. In addition to performing the FSTs, officers will also look for signs like slow speech response, impaired motor skills, disheveled appearance, watery eyes, and general lack of coordination.</p>

         <title>Southern California DUI Community Notes Bengals Linebacker&apos;s DUI Troubles</title>
         <description><![CDATA[<p>On Friday, <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">Southern California DUI</a> blogs buzzed with the news that homegrown sports hero, Ray Maualuga, had been arrested for DUI in Covington Kentucky. The 23-year-old Maualuga -- who was drafted by the Bengals in 2009 out of the University of Southern California -- reportedly had been driving with a BAC of .157 when his 2003 Pontiac spun out of control and smashed into a parking meter and two cars. No one was injured. But Maualuga did cause minor but significant property damage. The Bengal's linebacker tested at nearly twice the Kentucky (and California) legal limit of 0.08%. He is scheduled to return next month to Kenton County District Court for a hearing on the matter. In addition to the gamut of potential court imposed penalties, Maualuga faces the possibility of being disciplined by the NFL for violating the league's personal conduct policy.<img alt="rey-maualuga-dui.jpg" src="http://www.losangelesduiattorneyblog.com/rey-maualuga-dui.jpg" width="240" height="179" / align=left></p>

<p>This morning, Maualuga Tweeted to his Twitter followers about his remorse over what happened. He vowed to "do everything in my power to gain ur trust back! I will definitely learn from this!"</p>

         <title>Sentencing Issued in Southern California DUI Manslaughter Case</title>
         <description><![CDATA[<p>Last Friday, Corporal Elijah Fergusson (22) was sentenced for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">Southern California DUI </a>manslaughter for a February 22nd, 2008 car accident that resulted in the death of an area doctor, Dr. Michael Sein.<img src="http://www.losangelesduiattorneyblog.com/dui-ferguson.jpg" width="220" height="230" / align=left><br />
  <br />
On the night of the accident, Fergusson, a young marine who had just returned from a tour of duty in Iraq, had been playing drinking games on his marine base. His friends hid his car keys. But then Fergusson got into a phone altercation with his wife, who threatened to leave him. Determined to see her and his young child, the marine allegedly bullied his subordinates into letting him drive a Dodge Cavalier. But he got lost on the way to his house and ended up on McArthur Boulevard, where he slammed into the back of Seins’ vehicle at 74 mph.</p>

<p>Fergusson’s attorneys had argued that the marine got PTSD on his tour of duty in Iraq and that therefore he should be let off with a more lenient sentence. In the end, Judge Ronald Bauer of Superior Court agreed with the Deputy District Attorney’s recommendation of 15 years to life for the DUI manslaughter. (The family of the victim had asked for a 21 year to life term.)</p>

<p>The distinction between <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1359806.html"target=_blank">Southern California DUI vehicular manslaughter</a> and DUI murder can be subtle. Most non experts assume that charges of vehicular manslaughter, gross vehicular manslaughter while intoxicated, and DUI murder are interchangeable. But in fact they are extremely different. They carry different penalties and require different burdens of proof.</p>

<p>In California, a vehicular manslaughter charge can be filed if a driver causes a traffic accident due to negligence, gross negligence, or the commission of a traffic infraction. Whether or not you were under the influence when the accident happened is immaterial for this charge. </p>

<p>The charge of gross vehicular manslaughter while intoxicated is far more serious -- pursuant to penal code section 191.5(a), the prosecution must prove four points in order for this charge to stick:</p>

<p>1) The suspect was <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1358053.html"target=_blank">driving under the influence in Southern California</a> with a BAC level of 0.08 percent or more. <br />
2) The driver committed an infraction, misdemeanor, or other act that could lead to death. <br />
3) The infraction, unlawful act or misdemeanor could lead to someone’s death “with gross negligence.” <br />
4) The grossly negligent actions of the driver were the cause of the death of somebody.</p>

<p><a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1359796.html">DUI murder charges </a>are even more serious. These charges are often called “Watson murders.” If convicted, an individual can face 15 + years to life in jail. Watson murder charges are typically only brought in extreme cases. For instance, if the suspect has numerous DUI convictions and then gets behind the wheel while under the influence and kills someone, he or she might be subjected to a Watson murder charge. </p>

         <title>Former Hollywood DUI Defendant to Appear on Celebrity Rehab with Dr. Drew</title>
         <description><![CDATA[<p>Musician Mike Starr -- best known as the bass player for the ‘90s rock band Alice in Chains -- and former <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1520308.html"target=_blank">Hollywood DUI </a>defendant -- is scheduled to appear on the second episode of VH1’s Celebrity Rehab with Dr. Drew. The reality series follows the journeys of eight different celebrities who are in treatment for drug and alcohol addiction recovery. This year’s series will follow the stories of (among others) tattooed basketball legend Dennis Rodman, Heidi Fleiss (the famed former Madame of Hollywood), and Kari Ann Peniche, a Miss United States Teen pageant winner. <img alt="mike-starr-dui.jpg" src="http://www.losangelesduiattorneyblog.com/mike-starr-dui.jpg" width="200" height="302" / align=left></p>

<p>Starr, 43, has been arrested multiple times for drug and alcohol violations in cities as far flung as Salt Lake City, L.A., Seattle, and Pasadena. In 1994, he was booked at a Houston airport for possession of narcotics. In September 28, 2008, he was pulled over for drug possession in Los Angeles. In 2005, Starr was arrested in Seattle for yanking the hood ornament off of a man’s car.</p>

<p>If you're caught driving under the influence in Pasadena, what exactly happens to you? How do the police know whether or not you're over the legal limit?</p>

<p>One method the police use to determine your blood alcohol content (BAC) level is the blood test. Whether you're arrested for DUI in Pasadena, DUI in Hollywood, or DUI anywhere else in Southern California, the blood test must be administered in a very precise manner. First, a sample is taken from the vein of the suspect. Then a qualified technician must ID it and transport it for further testing. The results must then be reported and interpreted.          <title>Southern California DUI Charges for Chargers Receiver? Not Quite. But Last Few Days Clearly Have Not Been Kind to San Diego Football.</title>
         <description><![CDATA[<p>In January 2008, Chargers receiver Vincent Jackson got busted for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357085.html"target=_blank">driving under the influence in Southern California</a>. Today - nearly two years to the day since that arrest  - Jackson's driving troubles are again making headlines. Sunday night, just hours after the Chargers lost a bitterly contested battle against the New York Jets for the right to continue on in the playoffs -- Jackson got pulled over by San Diego police for blasting music from his car. The officer found that Jackson had been driving on a suspended license and had expired tags. San Diego 10 News reported that Jackson was not actually taken to jail -- but he did get handcuffed at the scene.<img alt="vincent-ackson-dui.jpg" src="http://www.losangelesduiattorneyblog.com/vincent-ackson-dui.jpg" width="220" height="230" /align=left></p>

<p>In addition to his January 2008 DUI charge, the troubled receiver is also grappling with a second <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1358053.html"target=_blank">Southern California DUI charge</a>; his BAC level in that case was allegedly twice the CA legal limit of 0.08%. He got a continuance on this charge last week, but if he's ultimately convicted, the NFL could suspend him.</p>

<p>What happens when you're arrested multiple times for <a href="http://www.losangelescriminallawyer.pro/lawyer-attorney-1357110.html"target=_blank">driving under the influence in Southern California</a>?</p>

<p>Obviously, penalties increase. But how, specifically? And how might these increased threats impact defense strategies?</p>

<p>In one sense, every case is different. Sentencing can depend on eclectic factors such as:</p>

<p>* the lawyers involved<br />
* the judge you get<br />
* the arguments you make<br />
* the context of the DUI arrest <br />
* your level of contrition<br />
* etc</p>

<p>That said, mandatory punishments for first time misdemeanor DUI offenses differ from from mandatory multiple DUI punishments in some key ways. </p>

<p>First-time punishments often include:</p>

<p>* CA driver's license suspension<br />
* $1000+ fine <br />
* Additional costs levied (can vastly exceed the $1000 fine) <br />
* 48 hours behind bars (six months maximum) <br />
* Forced DUI alcohol school <br />
* Mandatory insulation of an interlock ignition device (IID) -- even first-time misdemeanor DUI convicts must install an IID, subsequent to the law that went into effect on January 1, 2010<br />
* Probation and other court imposed terms of release</p>

<p>But if, within 10 years, you get convicted of two+ charges of DUI in Southern California, possible penalties can increase in the following ways.</p>

<p>* Fines: whereas with a first-time misdemeanor DUI, the maximum fine is $1000; with multiple DUIs, this number can go up -- way up.<br />
* License suspension: a second DUI nets you a two-year suspension. A third DUI nets you a 18 month suspension. And so forth.<br />
* Minimum jail time: A second DUI leads to a mandatory minimum sentence of 4-10 days behind bars. A 3rd DUI leads to a mandatory minimum of 120 days. A fourth DUI leads to a mandatory 180 days in jail. And that's all just for misdemeanor convictions.<br />
* Minimum time spent in alcohol school also goes up with each conviction.<br />
* Terms of probation can stiffen with each new DUI conviction.</p>
